透過進入或使用本網站，閣下確認已閱讀、明白及同意受本條款所約束。如果閣下不同意被這些條款及條件所約束，請勿下載本程式及/或立刻將本程式從閣下的移動設備移除以終止此協議。
1. 會員登記
閣下如透過Gourmet Dining Group網站登記成為Gourmet Dining Group 會員，閣下必須注意以下事項:
(i)
所提供的登記資料必須為完整及準確;
(ii)
必須於首次登記時輸入密碼，該密碼將會用作於核實閣下為Gourmet Dining Group 會員之身份並允許登入會員網站;
(iii)
完成首次登記後，亦可隨時更改密碼;
(iv)
必須妥善保存閣下之密碼，無論任何時間或情況下，閣下均不得將密碼向其他人士披露;
(v)
已授權我們假設任何以閣下之會員號碼及密碼使用Gourmet Dining Group 網站的人士均是閣下或已獲得閣下授權代表的人士。
2.
有關會員會籍轉移至Gourmet Dining Group 手機程式(“iGDG”) (只適用於香港地區)
我們已推出iGDG 作為會員登記會籍之嶄新模式，而現有會員將陸續使用iGDG手機程式。閣下了解每個會員會籍只可同時登記於一部手機，完成登記後現有會員將會更新為iGDG之會員會籍，其後所獲的積分亦將會累積於iGDG之會員會籍。
3.
有關iGDG/Gourmet Dining Group 會員尊享之推廣優惠，閣下必須注意以下事項:
(i)
所有會員尊享優惠的有效期限只適用於該次推廣活動指明之優惠推廣期內。
(ii)
iGDG/Gourmet Dining Group 會員尊享優惠只爲特選會員所使用，不能轉讓予其他人，並只限使用一次。
(iii)
使用iGDG/Gourmet Dining Group 會員尊享優惠時，必須出示iGDG/Gourmet Dining Group 提供之完整產品優惠券或現金優惠券編號方屬有效。
(iv)
特定產品優惠券之價格扣減優惠計算方法: 我們會先扣減該特定產品優惠券之金額，然後再計算會員折扣，讓會員尊享雙重優惠。
(v)
產品推廣優惠券之優惠不可兌換現金，亦不可與其他現金券同時使用。
(vi)
現金優惠券扣減上限為所列明的港元面值。
(vii)
如有任何爭議，我們保留最終決定權。
4.
推廣活動
Gourmet Dining Group 網站可能提供推廣活動，參加者需同意有關條款方可參與。
5.
知識產權
Gourmet Dining Group 網站所載的所有資料和內容（統稱"所有內容"），均受版權及可能涉及的其他知識產權 (「知識產權」) 所限制。而該版權屬我們所擁有。在未經我們事先給予的書面同意下，所有內容及本網站的任何部份之全部或部份，均不可被使用、轉載、複製、抄襲、銷售、轉售、存取、修改或以其他方式利用作任何用途。
6.
閣下的義務及責任
閣下進入或使用Gourmet Dining Group網站，即須遵從本條款及於本網站所發佈的進入或使用之特別警告或指示。閣下須根據法律、慣例及本著真誠行事。閣下不可作任何更改或修改本網站或任何內容或本網站的所出現服務，並不得以任何方式削弱本網站的完整性或運作。在不局限上文的原則下本條款的任何條文的一般性，如閣下因疏忽或故意違反本條款任何的義務，閣下須對我們所造成的所有損失及損害負責。
7.
第三方連結
我們無須為與Gourmet Dining Group 網站連結之任何站外網頁或任何其他網站的內容負任何責任或法律責任。Gourmet Dining Group 網站所出現的連結僅為方便，並不代表我們認可相關內容、產品、服務或供應商。閣下須自行承擔與任何站外網頁或任何其他網站連結之風險。我們並無責任檢查或評估亦不保證與Gourmet Dining Group 網站連結的站外網頁或任何其他網站的售賣品，我們亦不會就該等網頁及網站的行動、內容、產品或服務（包括但不限於其私隱政策及任何條款）負上任何責任或法律責任。閣下應小心查閱閣下瀏覽的所有站外網頁及其他網站之任何條款及私隱政策。
8.
個人資料（私隱）政策聲明
我們將確保其工作人員遵守嚴格的標準，尊重閣下向我們提交的個人資料並確保其安全性和保密性。
我們將依照收集該等資料時之目的繼續使用閣下的個人資料(包括姓名、電話及電郵)，以提供有關產品以及售後服務的消息、資訊及推廣資料、我們或我們的關聯公司的新服務。
9.
披露
我們將採取一切可行步驟，以保密閣下的個人資料，但我們或會將該等資料移轉予下列各方:
(a) 就Gourmet Dining Group 業務營運向其提供行政管理、電訊、電腦及其他服務的任何代理、承辦商或第三方服務提供者;
(b) 根據對Gourmet Dining Group 具約束力的任何法律規定，或為施行監管或其他機構所發出，而預期Gourmet Dining Group 須遵守的任何指引或實務守則，Gourmet Dining Group 有責任向其作出披露的任何人士。
10.
聲明、保證及責任限制
我們不就本條款或本網站作任何種類的聲明或保證（明示或隱含的）。我們會採取合理可行之程序，盡量確保與本網站有關之系統已裝置足夠之保安設施，並於系統運作時，對有關風險予以監控。
閣下同意，在適用法律所容許的最大範圍內，我們在任何情況下將不會就任何(i)業務受干擾；(ii)進入本網站延誤或中斷；(iii)數據傳送失敗、錯誤傳送、訛誤、破壞或其他修改；(iv)因與本網站有往來或本網站所出現的站外連結而招致之任何類型的損失或損害；(v)與閣下使用本網站有關（包括在與第三者網站進行超連結期間）而可能發生之電腦病毒、系統失靈或失常；(vi)內容的任何不準確或遺漏或誤導、虛假或欺騙性陳述內容；(vii)我們所不能合理控制的事情，而負上任何責任或法律責任（不論基於合約、侵權行為（包括疏忽）或其他方面的）。
11.
管轄法律、司法管轄權及爭議
凡與Gourmet Dining Group網站的所有使用及進入、本條款所預期的所有權利和責任及所有行動有關之任何爭議，均受當地法律所規管。凡與閣下瀏覽Gourmet
Dining Group網站有關之任何爭議，均須透過當地保密仲裁解決。

12.
一般
閣下確認並同意本條款構成我們與閣下之間有關閣下使用本網站之完整及獨有的協議，並且替代及規管所有先前的建議、協議或其他通訊。
我們保留更改本網站發佈的內容及更改本條款之權利。任何更改，立即生效。閣下其後繼續使用本網站構成閣下同意所有該等已更改的條款。我們可在給予或不給予事先通知下，終止本條款所授予的任何權利。閣下應立即遵從任何終止或其他通知。
本條款之內容不得被詮釋為閣下與我們之間設立任何代理關係、合夥關係或其他合作企業形式。我們未能要求閣下履行本協議的任何條文，並不影響我們在其後的任何時候要求該履行之全部權利，而我們對違反本協議的任何條文之寬免不得被當作為或被視為對該條文本身之放棄。
13.
可被分割
本條款之各項條文均為獨立及可被分割，如任何一項條款在任何適用之法律下被仲裁裁決或法院決定判定為不能執行、無效或非法，違規的條文不影響餘下條文之可強制執行性、有效性及合法性，在任何方面均不得受到影響或損害。
14.
適用文本
本章則之英文本與中文譯本文義如有歧異，概以英文本為準。
15.
閣下有權要求索取或更正我們所持有閣下的個人資料。如需作出有關索取或更正 或查詢有關本公司的私隱政策及做法的一般資料或投訴，請致函至我們尖沙咀郵政局郵政信箱98732號或電郵至dataprivacyoffice@fancl-hk.com[Q1] 予我們的私隱主任查詢。
16.
有關網上購物的條款及細則
更改或取消訂單
1.
所有已確定的訂單將不能更改或取消。
2.
所有推廣產品及換購貨品供應數量有限，售／換完即止。若客戶原來訂購的產品缺貨，該產品會在客戶的訂單上刪除，賬單及/或禮品積分將會作出相應的調整。
退款/換貨政策
1.
如非有問題、已損毀或錯誤的產品，所有產品恕不接受退款。
2.
已開封、已被使用或損毀之貨品均不能更換。詳細規條請參考下退款/換貨規條。
3.
若產品在送貨時有損壞情況、遺漏或送遞的產品錯誤，Gourmet Dining Group會向客戶替換該產品。如有任何查詢，顧客須於收貨日起計的7日內致電個別餐廳

運費不計算於退款金額內

每張訂單/貨品只可更換一次

2.
退貨/換貨程序
- 顧客須於收貨後7日工作天(以快遞送貨簽核記錄為準)內以電話通聯絡我們，請把以下資料告知我們。
A) 訂單編號
B) 退回貨品的資料及退貨原因。

退貨手續需要一至三週處理 (由收到退貨日起計算)，手續完成後，客戶服務部會通知顧客有關退換貨詳情
-收到退貨後，銀行將兩個月內把退款入帳予指定信用卡
如有任何爭議，Gourmet
Dining Group 將保留最終決定權。

Welcome
to www.gourmetdining.hk
or iGDG (the “Gourmet Dining
Group Websites”).
We
provide the services available on the Gourmet Dining Group Websites to you
subject to the following terms and conditions (the "Terms and Conditions").
By accessing or using the Gourmet Dining Group Websites, you are acknowledging
that you have read, understand, and agree, without limitation or qualification,
to be bound by the following Terms and Conditions (the “Terms and Conditions”) .
If you do not agree to be bound by these terms and conditions, you should not
download the Application and/or please terminate this Agreement immediately by
removing the Application from your mobile device.
1.
Membership Registration
If you have registered to be a Gourmet Dining Group Member through
the use of the Gourmet Dining Group Websites, please kindly note the following:
(i)
You warrant that the personal
information which you have provided upon registration is complete and accurate
in all respects;
(ii)
You must create and enter a
password upon registration; such password will be used to verify your Gourmet
Dining Group Membership and to enable you to gain access to the Members
Website;
(iii)
Your password may be changed at
any time after registration;
(iv)
You are responsible for
maintaining the confidentiality of your password and you must not under any
circumstances disclose your password to any third parties;
(v)
You authorize us to assume and
deem any use of, access or logon to the Gourmet Dining Group Websites using
your Membership number and password to have been so used, accessed or logged on
by yourself or by persons authorized by you.
2.
Transfer of Membership to Gourmet
Dining Group Mobile Application (“iGDG”) (Applicable to Hong Kong only)
We have released iGDG, a new mobile application for Membership
registration, and the Membership of existing Members will be transferred to iGDG. You understand that each Membership can
only be accessed by one mobile phone. Upon registration, existing Members will
be renewed as iGDG Members, and all subsequently earned points will be
accumulated under the iGDG Membership.
3. On iGDG/Gourmet Dining Group
Members’ exclusive promotional offers, please note the following:
(i)
All exclusive promotional offers will
only be applicable during the specified promotional period.
(ii)
iGDG/Gourmet Dining Group Members’
exclusive promotional offers are for the exclusive use of selected Members, and
can only be used once, and are not transferable.
(iii)
iGDG/Gourmet Dining Group promotional
offer coupons or cash coupons with valid serial numbers must be presented when
using iGDG/Gourmet Dining Group Members’ exclusive promotional offers.
(iv)
Method of calculation of discount for
specific product coupons: We will first deduct the coupon value from the price
as specified on that promotional offer coupon, and then calculate the Member’s
discount based on the discounted amount, thus allowing Members to enjoy double
benefits.
(v)
Product promotion coupons cannot be
redeemed for cash, and cannot be used in conjunction with other cash coupons.
(vi)
The maximum deductible amount is the face
value in Hong Kong Dollars (HKD) as specified on the cash coupon.
(vii) In
case of any disputes, our decision shall be final.
4.
Promotional activities
We may provide promotional activities on the Gourmet Dining Group
Websites. By participating in promotions, participants have to agree to be
bound by these Terms and Conditions as well as all promotional specific terms
and conditions.
5.
Intellectual Property
All
information and content contained on the Gourmet Dining Group Websites
(collectively, the “Content”) are subject to and protected by copyright and any
other intellectual property rights (“Intellectual Property”). We are the owner
of all copyright. Neither the Content, nor any other portion of the Website in
whole or in part may be used, reproduced, duplicated, copied, sold, resold,
accessed, modified, or otherwise exploited, in whole or in part, for any
purpose without our prior written consent.
6. Your obligations and
responsibilities
In the
access or use of the Gourmet Dining Group Websites, you shall comply with these
Terms and Conditions and the special warnings or instructions for access or use
posted on the Gourmet Dining Group Websites. You shall act always in accordance
with the law, custom and in good faith. You may not make any change or
alteration to the Gourmet Dining Group Websites or any Content or services that
may appear on the Gourmet Dining Group Websites and may not impair in any way
the integrity or operation of the Website. Without limiting the generality of
any other provisions of these Terms and Conditions, if you default negligently
or willfully in any of the obligations set forth in these Terms and Conditions,
you shall be liable for all the losses and damages that this may cause to us.
7. Third party links
We are not responsible or in any
way liable for the content of any off-Gourmet Dining Group Website pages or any
other sites linked to or from the Gourmet Dining Group Websites. Links
appearing on the Gourmet Dining Group Websites are for convenience only and are
not an endorsement by us of the referenced content, product, service, or
supplier. Your linking to or from any off-Gourmet Dining Group Website pages or
other websites is at your own risk. We are in no way responsible for examining
or evaluating, nor do we warrant the offerings of, off-Website pages or any
other sites linked to or from the Gourmet Dining Group Websites, nor do we
assume any responsibility or liability for the actions, content, products, or
services of such webpages and websites, including, without limitation, their
privacy statements and terms and conditions. You should carefully review the
terms and conditions and privacy policies of all off-Gourmet Dining Group
Website pages and other sites that you visit.
8. Personal information (privacy)

ensure that its staff will comply with strict standards, and ensure that the
personal data you have submitted to us will be kept safely and in strict confidence.
We will continue to use the
personal data (include Name, phone number and e-mail address) collected for the
purposes as stipulated at the time of collection, including the provision of
product information and after sales service updates, information and
promotional materials, as well as new services of our company and our
affiliates.
9. We will
take all practicable steps to keep your personal data confidential but we may
transfer such data to the following parties:
(a) Any
agent, contractor or third party service provider who provides administrative,
telecommunications, computer and other services to Gourmet Dining Group with respect to the
operation of its business; and
(b) Any
person to whom Gourmet Dining
Group is under an obligation to make disclosure under the requirements
of any law binding on Gourmet
Dining Group or for the purposes of any guidelines or codes of practice issued
by regulatory or other authorities with which Gourmet Dining Group is expected to comply.
10. Disclaimer of warranties
We make
no representations or warranties of any kind whatsoever, express or implied, in
connection with these Terms and Conditions or the Gourmet Dining Group
Websites. We shall take reasonable and practicable steps to ensure that
adequate security measures are in place, and to monitor all relevant risks
during system operation.
You agree
that, to the fullest extent permitted by applicable law, we will not be
responsible or liable (whether in contract, tort (including negligence) or
otherwise), under any circumstances, for any (i) interruption of business; (ii)
access delays or access interruptions to the Gourmet Dining Group Websites;
(iii) data non-delivery, misdelivery, corruption, destruction or other
modification; (iv) loss or damages of any sort resulting from use or access to
the Gourmet Dining Group Websites and or any other websites through links from
the Gourmet Dining Group Websites; (v) computer viruses, system failures or
malfunctions which may occur in connection with your use of the Gourmet Dining
Group Websites, including during hyperlink to or from third party sites; (vi)
any inaccuracies, omissions or misleading, false or deceptive statement in the
content; or (vii) events beyond our reasonable control.
11. Applicable laws and jurisdiction
All use of and access to the Gourmet
Dining Group Websites, and these Terms and Conditions shall be governed by and
construed in accordance with the local laws. All controversies and disputes
arising out of or relating to the Gourmet Dining Group Websites and these Terms
and Conditions shall be resolved through arbitration in the country/
jurisdiction whose law governs these Terms and Conditions.

and iGDG shall be governed by the laws of Hong Kong Special Administrative
Region of the People's Republic of China.
12.
General provisions
You
acknowledge and agree that these Terms and Conditions constitute the complete
and exclusive agreement between us concerning your use of the Website, and
supersede and govern all prior proposals, agreements, or other communications.
We
reserve the right to modify the Gourmet Dining Group Websites’ Content and
Terms and Conditions. Any modifications will be effective immediately. Your
continued use of the Gourmet Dining Group Websites following such modifications
will be conclusively deemed acceptance of any changes to these Terms and
Conditions. We may, with or without prior notice, terminate any rights granted
under these Terms and Conditions. You shall comply immediately with any
termination or other notice.
Nothing
contained in these Terms and Conditions shall be construed as creating any
agency, partnership, or other form of joint enterprise between you and our
company. Our failure to require your performance of any provision hereof shall
not affect our full right to require such performance at any time thereafter,
nor shall our waiver of a breach of any provision hereof be taken or held to be
a waiver of the provision itself.
13. Severability
Each term and provision is
independent and severable from other terms and provisions in these Terms and
Conditions. In the event that any term or provision of these Terms and
Conditions shall be adjudicated or adjudged unenforceable, invalid or illegal
by any arbitral tribunal or court, such unenforceability, invalidity or
legality shall not render the other terms and provisions in these Terms and
Conditions unenforceable, invalid .
14. Translation (prevail clause)
In the event there is a conflict
between this English version of the Terms and Conditions and a translated
version, the English version shall prevail.
15. You have the right to request access to
or correction of your personal data held by us. If you want to make such request or have
any questions or complaints about our Privacy Policy, please send your enquiry
